Terms of Service

By using Draftball at draftball.app (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. Draftball is operated by Stephen Schaller as an independent solo developer.

Draftball is currently in beta. The Service is provided "as is" for the purpose of testing and gathering user feedback. Features may be added, removed, or changed without notice. Data loss can occur during the beta period; while we take reasonable steps to prevent it, we cannot guarantee that your data will always be preserved.

You must be at least 13 years old to use Draftball. By using the Service, you represent that you are at least 13 years old. If you are using the Service on behalf of a school, employer, or other organization, you represent that you have authority to bind that entity to these terms.

You are responsible for any activity that occurs under your account, including maintaining the security of your sign-in credentials. Do not share your account with others. Notify us immediately if you suspect unauthorized access.

You may close your account at any time by emailing stephen.schaller@gmail.com.

You agree not to use Draftball to:

• Violate any applicable law or regulation.
• Harass, threaten, or abuse other users.
• Impersonate another person or misrepresent your identity.
• Interfere with the Service's operation, e.g. by scraping, denial-of-service attacks, or attempts to bypass authentication.
• Reverse engineer, decompile, or extract proprietary code or data, except as permitted by law.
• Use the Service to operate a paid fantasy contest, a wagering platform, or anything that involves real-money payouts. Draftball is for friendly competition only.

We reserve the right to suspend or terminate accounts that violate these rules.

As the commissioner of a league, you are responsible for the conduct of your league members and any rules you set. Draftball provides tools to manage your league but does not enforce or arbitrate disputes between league members.

Team names, crests, and other content you create must not be hateful, obscene, threatening, infringing, or otherwise objectionable. We may remove any content that violates these rules without notice.

Draftball's code, design, and trademarks are the property of Stephen Schaller. Premier League player and match data is provided by Sportmonks under license. You retain ownership of content you create (team names, crest configurations, etc.), but you grant us a non-exclusive, royalty-free license to display, store, and process that content as necessary to operate the Service.

We strive to keep Draftball available 24/7, but we make no guarantees about uptime, performance, or data integrity. The Service may be unavailable from time to time due to maintenance, hardware failures, or factors beyond our control. We are not liable for any losses resulting from Service unavailability.

We may suspend or terminate your access to Draftball at any time, with or without notice, if we believe you have violated these terms or for any other reason at our discretion. You may terminate your account at any time by emailing us.

Upon termination, your access to the Service will end and we will delete your personal information per our Privacy Policy. League records may be retained in anonymized form.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAFTBALL AND STEPHEN SCHALLER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to defend and indemnify Stephen Schaller and Draftball from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third-party right.

These terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of the Service shall be resolved in the courts of the United States.

We may update these Terms of Service from time to time. We will notify you of any significant changes by email or by posting a notice on the website. Continued use of the Service after the updated terms take effect constitutes acceptance of those changes.
